Usage of GitHub Copilot for Commercial Projects under Student Developer Pack

Hi everyone,

I have access to the GitHub Student Developer Pack, which includes GitHub Copilot. Am I allowed to use Copilot to develop a commercial or business product?

You should be able to use Copilot as if you had a regular paid subscription. You can read GitHub Copilot Product Specific Terms here.

Short answer: Yes — the Copilot access you get through the GitHub Student Developer Pack is the same individual Copilot offering and may be used for commercial projects. However, use is subject to GitHub Copilot’s terms and your legal obligations.

Key things to keep in mind

• The Student Pack gives you a Copilot subscription (free while eligible). That subscription lets you use Copilot-generated suggestions in your projects, including commercial ones.
• You remain responsible for ensuring the code you include in a commercial product complies with any third‑party license obligations. Copilot suggestions may sometimes mirror public code; you should review suggestions and remove/replace anything that creates license or copyright risk.
• Follow Copilot’s Terms of Use / Service and GitHub’s Acceptable Use/Content policies. Don’t rely on Copilot for secrets, regulated data, or outputs that require guaranteed correctness without review.
• If you’re working as part of a company or need organization-wide controls (audit/logging, license compliance), consider Copilot for Business which has features targeted at teams."

What I can assure you is that there's no difference between Copilot PRO obtained in the Student Developer Pack and a paid subscription.
